Terms and Conditions

OPENING STATEMENT

 

The Green Ant Christmas Craft Fair is a Craft, Art and Design fair.

 

The quality of your application will greatly influence your selection for an invitation to the fair.

 

Stallholders who are able to demonstrate the quality and uniqueness of their goods will be prioritised for selection. Your ‘story’ (description/elevator pitch) will also enhance your chances of receiving an invitation to attend.

 

Previous attendance is not a guarantee of a successful application.

 

INVITATIONS & ATTENDANCE

Attendance as a stall holder is by invitation only. Submission of an application form does not equate to an invitation but is rather an expression of interest in attending. Successful stall holders will be issued a separate invitation.

Bookings are limited due to space restrictions. Stall holders whose work meets our criteria but cannot be immediately accommodated will be placed on a waiting list. We will advise you if you fall into this category and will inform you as soon as possible should a place become available.

All stall holders inside the venue must attend and be open for trading from 9am -4pm both days. No packing up is to occur before 4pm on Sunday.

All stall holders must set up within the boundaries of their designated area and must consider the safety of themselves, other stall holders and patrons, ensuring their set up does not pose any safety risks. Stall holders must adhere to any information or requirements provided by the organisers in relation to fixtures and fittings for their stall including marquee type.

Site allocation is at the organisers discretion and will not be negotiated at the time of set up.

Stall holders are expected to display their work in an inviting way and are expected to behave in a respectful and professional manner towards each other, members of the public, organisers (The Flying Gecko Project) and their representatives.

Public walkways must be always kept clear.

Security of a stall holder’s stock, produce, equipment, cash, and personal effects is the responsibility of the stallholder.

Stallholders are expected to always act in a professional manner.

 

Further information and instructions are provided in the stall holder handbook.  The content of the handbook must be complied with as part of attendance at the fair. This handbook is essential reading for all attendees. Please check the handbook if you have any questions before emailing.

Waste Management

Stallholders are required to remove all excessive rubbish from the market.

Rubbish bins provided are for the public and not to be used to dispose of waste arising from your stall including food truck waste, packaging or damaged or broken items – please take these with you.

At the end of trading hours, the stallholder is required to clean their space and remove all items including any broken racks, coat hangers, shelving, baskets, or accessories. Also please remove the tape on the ground that marks the corners of your stall.

We encourage using eco-friendly bags such as recycled paper or enviro bags.

Online Directory

Listings on the online directory are at the discretion of the organisers.

Generally, the directory is for stalls that have booked or attend the fair.

This is a complimentary service we provide to our fair community included in your stall fees.

Intellectual Property Disputes

We do not get directly involved with any disputes between stall holders relating to intellectual property rights. By participating in the Green Ant Craft Fair you agree that the details of any such disputes shall be confidential information for the duration of the fair (with the exception of you seeking legal advice).

Further, you must endeavour to resolve any disputes through your own independent means with the other party, whether that be a stall holder or otherwise. To avoid any disruptions to the fair, if any disputes with other stallholders arise, we ask that you deal with these matters outside of trading hours.

We are committed to encouraging creative endeavour and original products and safeguarding intellectual property rights. Should a dispute arise relating to products sold at the fair (or related marketing material), while we will not adjudicate in relation to that dispute, we reserve the right to request that a stall holder remove the products or items for sale which are in dispute from display and not trade with the products for the remainder of the market trading hours

ITEMS FOR SALE

All goods sold at the Green Ant Christmas Craft Fair must be of high quality and be substantially the stall holders own work, or the work of a collective that is represented by a member at the craft fair.

It is expected that at least one person who is directly involved in the making, art or craft will be present at all times during trading. This allows members of the public to interact with and ask question of the artist/crafter/maker. The Green Ant Christmas Craft Fair exists to provide an outlet for local artists, craftspeople, makers, designers and creatives.

We prioritise locally made, designed and created goods and objects. We do accept Australian made and imported goods under specific circumstances. In your application you must be able to detail the skill and creative process you undertake in respect of your goods.

 

We accept that the designing of an object can take considerable skill. For your application to be successful you need to describe how you use your acquired skills to create it. It is not enough to make the statement that you designed it.

The base of your product can be imported but it must either have had major changes made to it, be designed by you in a manner demonstrating considerable skill, or in the case of visual artists, display your own work in a very visible manner.

Stall holders are not permitted to sell goods on behalf of other artists or makers. Shared stall spaces are available as an option during the application process. The Flying Gecko Project requires full details of both businesses and therefore both makers are required to submit an application. Stallholders who do not comply with this condition will not be invited to attend.

It is the responsibility of stallholders to ensure their products comply with the relevant safety and labelling standards for their items. The Flying Gecko Project takes no responsibility for products/stallholders who fail to comply with standards and regulations.

Stall holders are not permitted to sell offensive, illegal, prohibited, counterfeit or unauthorised goods including goods bearing trademarks that the stallholder does not have a licence to sell.

It is the stall holder’s responsibility to ensure that the products they are making do not infringe on any third party rights, including the intellectual property rights of other stall holders and businesses.

If you are unsure of whether some of your items for sale are suitable, please ask in advance of the craft fair.

If you are found to be selling goods that do not comply you will be asked to remove them from your stall. Refusal to do so or providing misleading information to craft fair organisers will result in the cancellation of your stall and the possibility you will not be invited to attend in future.

Stalls selling food, cosmetics (including soaps) or therapeutic goods must have relevant insurance and a copy of this must have been provided to The Flying Gecko Project prior to the event.

The Flying Gecko Project is not responsible for loss, theft, breakages or damage of any product or display or personal belongings brought into the venue.

 

STALL FEES & PAYMENT

Payment will be due one calendar month prior to the commencement of the fair and the due date will be listed on your invoice.

If there is an issue with you paying by this date please let organisers know as soon as possible. Failure to pay by the due date or by an agreed date will result in your site being surrendered and allocated to another person on the waiting list.

All stall holders must have paid stall fees in full before commencement of the fair, without exception.

Shared Stalls:​​

As previously mentioned, potential stall holders wanting to share stalls must both apply individually and applications must clearly state intention to share a space and with whom.

You must both hold your own insurance as necessary.

CANCELLATION AND REFUND POLICY

The Flying Gecko Project has the right to cancel the event due to security/safety concerns including COVID-19 public health orders, structural malfunctions or weather conditions. As much notice as possible will be given should cancellation be required. Should the event be cancelled The Flying Gecko Project will endeavor to reschedule the event for the next practical date and time. The Flying Gecko Project will not be liable for any loss of resources (equipment, staff etc.) if a cancellation or postponement decision is made.

There are general costs, advertising costs, permits and many hours that go into the event that mean we cannot offer full refunds for reasons outside of the organisers’ control.

If we cancel:


Should the event be cancelled due to reasons of emergency, danger, weather conditions, thunderstorms, severe wind, heatwaves, safety, health concerns (this includes COVID19), or other reasons that are not in reasonable control of the The Flying Gecko Project organisers, then we offer will offer a 50% refund of your stall fee.

If you cancel:


No refunds/credits or transfers will be given for site cancellations where less than two weeks notice is given prior to the date of the event.

The Flying Gecko Project reserve the right to terminate an invitation should a stall holder:

  • Not comply with terms and conditions

  • Commit a criminal act at the fair

  • Fail to attend and set up in a reasonable time before trading hours

  • Fail to behave in a manner that complies with fair etiquette

  • Be found to have submitted a misleading application and/or items for sale are not quality or pre-approved

  • Any other disorderly conduct as determined by The Flying Gecko Project.

Should any of the above occur, the stall holder will therefore not be eligible for a refund.

PRIVACY POLICY

The Flying Gecko Project respects our customers’ privacy and is committed to protecting your personal information. As an Australian organisation we are bound by the Privacy Act 1988 when collecting, using, holding, handling and transferring any personal information provided to us. We have practices, systems and procedures in place to ensure we protect your personal information.

The information we collect includes but is not limited to:

Full Name, Email Address, Address and Mobile Number.

 

The above information can only be accessed by authorised The Flying Gecko Project owners.

 

How we use your information:

To carry out event communication and administration. Mobile numbers are only used to contact stallholders quickly or in the case of an emergency. We will not sell or rent your personal information to third parties - ever.

 How do we store your information and for how long?

The Flying Gecko Project retains your information until all of our legal and or tax obligations have expired and or we no longer need the information for the purpose we collected it. Your information may be stored in a physical format or as electronic data, however, we will take the necessary steps to destroy it.
